Mobile phone numbers may be used to all or send recurring text messages to you to administer the Services. You may be liable for standard SMS and-per-minute charges by your mobile phone carrier. We may also send you push notifications (with your consent where required by applicable law) which you can opt out of on your mobile device. Data rates may apply.
Booking SMS Alerts:
We use your phone number to communicate with you. Each time you initiate a booking on our website as a returning Hits member, we will send a verification code (to the phone number you are required to enter) by text message to authenticate your Player Profile during the sign-up process. As outlined in our website Terms of Use, you may expressly consent to receive additional text messages from Batbox by booking a batting cage time. We may send you additional transactional text messages or other notifications about your booking or reservation status at Batbox.
Batbox Hits SMS Alerts Program:

When you opt-in to Batbox Hits SMS alerts, we will send you marketing messages about Batbox promotions, events, and discounts.

You can cancel the SMS service at any time. Just text "STOP" to the shortcode. After you send the SMS "STOP" to us, we will send you an SMS message to confirm that you have been unsubscribed. After this, you will no longer receive SMS messages from us. If you want to join again, just sign up as you did, and we will send you SMS messages again.

Carriers are not liable for delayed or undelivered messages

As always, message and data rates may apply for any messages sent to you from us and to us from you. You will receive up to 3 notifications per week. If you have any questions about your text plan or data plan, it is best to contact your wireless provider.

You must be 18 or older to participate in the Batbox Hits mobile text program. If you are a minor, you must provide adult permission to join in Batbox Hits.

By providing your mobile phone at opt-in, you consent to receive future recurring automated marketing text messages to the mobile number provided from or on behalf of Batbox. You also acknowledge that your agreement to receive these messages is not required as a condition of purchase.

Message & data rates may apply. All charges are billed by and payable to your mobile service provider. Batbox does not charge you for sending or receiving text messages. You can unsubscribe at any time by texting "STOP" to XXXXX. A text will be sent confirming your removal. Batbox reserves the right to remove subscribers from our messaging database. This program is not available on all carriers, and Batbox is not liable for any delays in the receipt of any SMS messages or undelivered messages.

Data obtained from you in connection with this text message service includes your cell phone number, your carrier's name, the date, time, and content of your messages, and other information you provide to Batbox as part of this service. We use this information to contact you with products or services that may be of interest to you and to provide the services you request from us. Your information may be shared with third parties for Batbox's services.

Disclosure of Your Information
We may disclose information that does not identify you specifically, such as information that has been aggregated in such a manner that it no longer reveals your specific identity, without restriction. We commit to maintaining and using deidentified data without attempting to restore that data so that it allows individuals to be identified.

Unless we request it, we ask that you not send us, and you not disclose, any sensitive personal information (e.g., information related to race or ethnic origin, political opinions, religion or other beliefs, health, genetic, or biometric data, criminal background or union affiliation) on or through the Services or otherwise to us.

Disclaimer of Applicability of Certain State Data Privacy Laws
We are not subject to regulation under the California Consumer Privacy Act of 2018 (“CCPA”), the Colorado Consumer Privacy Act (“CPA”), the Connecticut Data Privacy Act (“CTDPA”), the Florida Digital Bill of Rights, Oregon’s Consumer Privacy Act, the Utah Consumer Privacy Act (“UCPA”), or the Virginia Consumer Data Protection Act (“VCDPA”) (collectively “State Data Privacy Laws”). Therefore, even if you are a resident of California, Colorado, Connecticut, Florida, Oregon, Utah or Virginia and we may have personal information about you that is the type of information subject to the State Data Privacy Laws, the State Data Privacy Laws are not applicable to us or to our relationship with you.
